In 2007, Apple introduced the iPhone, which instantly became one of the most talked-about consumer products ever. Thousands of customers lined up to be the first to buy the phones, which featured computing and Wi-Fi capabilities, along with a crisp, computer-like display on an innovative touch screen. Rivals, including Google, rushed phones with similar features onto the market.

In October 2011, the company unveiled an eagerly awaited new version of the device, the iPhone 4S, that included a "virtual assistant," Siri, that recognized voice commands by users to schedule appointments, dictate text messages and conduct Web searches.

Although the new phone was virtually indistinguishable on the outside from its predecessor, the iPhone 4, it was packed with better technical innards, including a more advanced camera. The phone also included a more powerful chip known as the A5, the same microprocessor that acts as the brains inside the iPad.

Though many Apple fans expressed disappointment about the lack of a design change, consumers reacted very differently. Apple said it sold more than four million iPhone 4S's during the device's first weekend on sale.

In January 2012, after a blockbuster fourth quarter, Tim Cook, Apple's chief executive, said the iPhone 4S accounted for the majority of iPhone sales. This statement took on added significance considering that at the time, the iPhone 3GS was free with a two-year contract, and the iPhone 4 cost $100. Even in a down economy and with a free iPhone in its portfolio, Apple still managed to sell the expensive, newer 4S to most of its customers.

Yet the free and reduced-price iPhones were still important to the company's business. Tero Kuittinen, a senior analyst at MGI Research, said the free iPhone 3GS gave Apple the opportunity to expand aggressively into markets where smartphones were not as popular yet, like China and Africa.

Jan Dawson, an analyst with Ovum, said not to underestimate the power of the free iPhone 3GS and the cheaper iPhone 4. "You'd better believe the other iPhones are selling, too," he said. "They're suddenly competitive with the lower-end smartphones that you used to get if you couldn't afford an iPhone."

The iPhone4s runs on two kinds of cellphone networks, GSM and CDMA, allowing its operation worldwide. Prices start at $199 for a model with 16 gigabytes of storage. The new phone is available on the AT&T, Verizon and Sprint networks.

In a Race With Android

Apple's strategy helped narrow the lead that had been gained by Android phones, powered by Google's operating system. Nielsen, the audience measurement firm, reported that 61.6 percent of United States smartphone consumers surveyed in October 2011 said they had gotten an Android phone within the previous three months, while only 25.1 percent got an iPhone.

By December 2011, though, Android's lead among people who had recently acquired a smartphone had narrowed to 46.9 percent, while 44.5 percent of consumers said they had bought an iPhone, Nielsen said. About 57 percent of iPhone owners in December said they got the new iPhone 4S, while the rest, 43 percent, got older iPhones.

Legal Dispute

Soon after the iPhone 4S was introduced, Samsung Electronics said that it would seek to block its sale in France and Italy, asserting that the phone violated its patents. In seeking a court order against its rival in the two large European markets, Samsung indicated a more aggressive stance in its expanding patent battle with Apple.

Samsung said that it planned to file for preliminary injunctions in other countries after further review. The two companies are locked in about 20 legal disputes over patents in nine countries, including Australia, Britain, Germany, Japan, the Netherlands and the United States.

The fight began when Apple sued Samsung in April 2011 in the United States, asserting that the Samsung Galaxy lineup of smartphones and tablet devices "slavishly" copied the design, user interface and packaging of the iPhone and iPad. Samsung responded with its own lawsuits accusing Apple of violating its intellectual property.

An Issue of Control

Apple likes to maintain tight control over what programs can appear on the iPhone — a task that became a little bit harder in July 2010, when the Library of Congress, which has the power to define exceptions to an important copyright law, said that it was legal to bypass a phone's controls on what software it will run to get "lawfully obtained" programs to work.

The issue has been a topic of debate between Apple, which says it has the right to control the software on its devices, and technically adept users who want to customize their phones as they see fit.

Apple has also said that altering the phones encouraged the pirating of applications, exposed iPhones to security risks and taxed the company's customer support staff. But iPhone hobbyists say they simply want to have free range to use certain features and programs on their phones that Apple has limited or failed to offer.

Can Apple win in an intensely competitive market against rivals that are openly licensing their software to scores of companies? It faces that challenge not only in phones, but also in the market for tablet computers, where the iPad is about to take on a similar set of rivals.

The stakes are huge, as the mobile computing market could prove to be larger than the PC market ever was.

That leaves little room for error at Apple. The company must continue to create hit products, as a single misstep could give Android and other rivals an opportunity to make inroads and steal market share.

Amtrak iPhone scanIt's hard to believe in the 21st century that train conductors are still punching tickets, but it appears that era has finally come to an end for Amtrak, who is rolling out iPhones to 1,700 conductors for a digital check-in process this summer. Hey, that makes us want to book a ticket to some far-off destination -- until we realize it's actually cheaper to do that on a plane, and you'll get there a whole lot faster. Oh well. In the meantime, here's the rest of the tech news for Monday, May 7, 2012.

Amtrak Enlists iPhone as Handheld Ticket Scanner

Riding the rails may be one of the oldest modes of transportation in the U.S., but that doesn't mean it can't be modernized, just a little. The New York Times is reporting that Amtrak has started using the iPhone as a portable ticket scanner, with conductors trained on the handset as far back as last November. The company expects that number to reach 1,7000 conductors by this summer, with the service reaching coast-to-coast. "You don't even need to print the document and bring it with you," said Matt Hardison, the Amtrak rep who helped initiate the program. "We've made a number of important improvements for both our customers and Amtrak, all in one fell swoop." Does this mean Tom Hanks will be out of one of his many jobs from The Polar Express? Guess he can start tapping messages to the kiddies on the iPhone's virtual keyboard from now on...

Twitpic Releases Official iPhone App, Android on the Way

As Twitter continues to push users toward its own photo hosting service for the microblog, the folks at Twitpic are fighting back. Announced today on the Twitpic Blog, the company has released a free, official Twitpic app for the iPhone, with an Android version promised "within the month." In addition to having an easy way to share photos and videos, the Twitpic app allows you to view content from other users, add comments and see daily popular content, along with a built-in photo editor that offers simple editing tools and photo filters to apply to your work before sharing. The app is now live in the App Store, so you know what to do.

Oracle v. Google Ends with Partial Verdict

The Verge is reporting that the courtroom fireworks between Oracle and Google remain partially unresolved, even after the jury had a weekend to break their deadlock. The jury has found Google "liable of infringing Oracle's Java-related copyrights," but the issue of whether or not Google made fair use of Java APIs appears to be stuck. Needless to say, Google is calling for a mistrial, while Oracle seems to already be breaking out the victory champagne in an official statement. "Oracle, the nine million Java developers, and the entire Java community thank the jury for their verdict in this phase of the case," the Oracle statement reads. "The overwhelming evidence demonstrated that Google knew it needed a license and that its unauthorized fork of Java in Android shattered Java's central write once run anywhere principle. Every major commercial enterprise -- except Google -- has a license for Java and maintains compatibility to run across all computing platforms." We may have to wait until May 14 to see how this plays out, when both sides must submit responses to Judge William Alsup, who will have the final word.

Cult of Mac Sources Claims to Have Seen FaceTime, Siri-Enabled Apple HDTV

It should go without saying at this point, but take the following rumor with an enormous grain of salt -- we're not sure we buy this one at all, but pass it along like so many others for readers to make of what they wish. Cult of Mac is reporting that an anonymous source claims to have seen a prototype of the fabled Apple HDTV, and actually lived to squeal about it. So what's it look like? Think of a current LED-backlit Cinema Display, only "much bigger." (Well, yeah… duh.) The set reportedly comes with a built-in iSight camera for FaceTime chats from the comfort of your couch, and performs a wide variety of its television duties with the help of Siri. None of that sounds too completely unbelievable, but we figure Apple's going to have to do better than that to get most of us to toss out the HDTV currently mounted in our home theatre systems...

Microsoft Stores Now Offering $99 Xbox 360 -- With Contract

Looks like Microsoft is trying to get one last gold rush out of its Xbox 360 before the new model (eventually) arrives. According to Joystiq, Microsoft Stores are now offering Xbox 360 deals for a mere $99, including Kinect, Xbox Live Gold service and a two-year warranty. But there's a catch: You'll have to shell out $14.99 per month for the next two years to get it at that price. As the website notes, that's about $460 spread out over the next two years, which doesn't sound so amazing when you can get the same package for $399 (or less) by paying upfront. Hit the link to grab a coupon, should you want to take Redmond up on the deal.

iOS 5.1.1 software updateYou won't find a ton of new features waiting for you, but iOS devices have a new software update waiting for them on this sleepy mid-Monday that brings the version number up to 5.1.1 and squashes a few minor bugs.

Apple has released iOS 5.1.1, a modest update to iOS 5.1, which was released back in March just ahead of the new iPad. The update mostly offers some bug fixes and reliability improvements, but the changes sound promising enough to install -- assuming you haven't jailbroken your device, that is.

iOS 5.1.1 includes the following changes:

• Improves reliability of using HDR option for photos taken using the Lock Screen shortcut

• Addresses bugs that could prevent the new iPad from switching between 2G and 3G networks

• Fixes bugs that affected AirPlay video playback in some circumstances

• Improved reliability for syncing Safari bookmarks and Reading List

• Fixes an issue where 'Unable to purchase' alert could be displayed after successful purchase


Users can install iOS 5.1.1 using the over-the-air Software Update from your device Settings, or by plugging into iTunes and downloading it from there. As always, recommends devices are plugged into a power source while installing.

Spun off from the popular Burnout arcade racing franchise on consoles, Burnout Crash turns a horrifying real-life fate – causing a huge vehicle pile-up – into a comical high score chase, as you attempt to pull more and more cars and buildings into your explosive wave of destruction.

Each stage starts with your four-wheeler of choice barreling towards a busy intersection, with swipes of the touch screen used to guide its path. Upon impact with another vehicle, the roads become a playground for your car, which can be repeatedly detonated and slid across the screen to slam other drivers. Depending on the game mode (three are included), you'll be aiming for the highest total damage amount, trying to keep other cars from driving by untouched, or aiming to trigger over-the-top special attacks – like a massive sea creature or laser-equipped UFO.

It's dumb fun, and the game features equal parts of both. Burnout Crash seems to take influence from pinball, but beyond that, the '80s pop song clips, goofy sound effects, and oddball imagery (Pizza of Fortune?) don't really make a whole lot of sense together. But smashing together cars remains plenty enjoyable, and with 18 intersections and numerous objectives, the excitement thankfully doesn't burn out too quickly.

The bottom line. Like a Hot Wheels fantasy turned into a touch screen trifle, this silly car-smashing affair serves up an amusing time.

Requirements: 

iPhone, iPad, or iPod touch running iOS 4.0 or later

Positives: 

Entertaining blend of driving, pinball, and mass destruction. Good fit for iOS touch screens. Quite a bit of content with solid variation between modes.

Negatives: 

Scatterbrained attempts at humor can be off-putting. Not always clear why certain events are triggered in the stages.
